Privilege for marital counseling records

Ahrend Law PLLC has appealed a lower court’s determination that a married couple impliedly waived the statutory privilege for marital counseling records just because they filed a lawsuit to recover damages for misdiagnosis of their child with cancer, followed by rounds of unnecessary chemotherapy.

The couple had engaged in joint and separate counseling sessions with a marriage counselor, which was unrelated to the injury to their child and was completed before their child was injured.

Oral argument is scheduled before the Washington Supreme court on November 14, 2019.
